Professor Wenwei Guan Delivered a Keynote Presentation at a WIPO AMC Seminar in Hainan
On 17 June 2026, Professor Wenwei GUAN attended the Seminar on IP Protection and Diversified Dispute Resolution Mechanisms co-hosted by the Hainan High People’s Court and the WIPO Arbitration and Mediation Center (AMC Shanghai) in Haikou. Professor Guan delivered a keynote presentation titled “Leave Market Disputes to Market: WIPO AMC’s Decade of Judicial Collaboration & Beyond.” He suggested, as the child of the Industrial Revolution, intellectual property’s creation, diffusion, and dispute resolution facilitate the evolution and together form an integral part of the creativity market. Building on the WIPO AMC’s judicial collaboration with the Supreme People’s Court (SPC), WIPO AMC (Shanghai)’s “commission mediation” service constitutes a critical component of the creative market—leaving market disputes to the market, revealing the market’s dynamics, and demonstrating the authority’s confidence in an open rather than a closed market.
The WIPO AMC is a specialized, neutral, and non-profit institution established in 1994 by WIPO. Based on the 2017 SPC-WIPO Memorandum of Understanding and authorized by the Ministry of Justice, the WIPO AMC Shanghai Service has, since 2019, been providing commission mediation for foreign-related IP disputes referred by people’s courts from Shanghai, Fujian, Hainan, Guangdong, Chongqing, and Sichuan under respective agreements. Successful court-referred mediation settlements are enforceable as official Chinese court judgements upon court recognition.
2026年6月17日，關文偉教授出席了由海南省高級人民法院與WIPO仲裁與調解中心（WIPO AMC）在海口共同主辦的“知識產權保護與多元化糾紛解決機制研討會”。關教授發表了題為“讓市場糾紛迴歸市場：WIPO AMC十年司法調解合作及展望”的主旨發言。他指出，知識產權作為工業革命的產物，其創造、傳播和糾紛解決共同推動創意市場的演進、並同時構成市場不可或缺的一部分。在WIPO AMC與最高人民法院司法合作的基礎上，WIPO AMC（上海）的“委託調解”服務構成了創意市場的關鍵環節——既讓市場糾紛回歸市場，也展現了市場的活力，同時體現了政府對開放、自由市場的信心。
WIPO AMC是世界知識產權組織於1994年設立的一個專門性、中立且非營利的機構。根據2017年“最高人民法院與WIPO諒解備忘錄”，並經司法部授權，WIPO AMC上海中心自2019年起，依據相關協議，為上海、福建、海南、廣東、重慶、四川等地人民法院委託的涉外知識產權糾紛提供調解服務。經法院委託並調解成功的案件，在經相應人民法院確認後，可作為中國法院的正式判決予以強制執行。
