Professor Wenwei Guan Shared His Recent Research at the Intellectual Property Court of the Supreme People’s Court

On the morning of Saturday, May 9, 2026, Professor Wenwei Guan, invited by the Intellectual Property Court of the Supreme People’s Court (SPC), as the second keynote speaker in 2026 of SPC Intellectual Property Court’s New Knowledge Forum, delivered the talk in Beijing to the judges of the SPC Intellectual Property Court, as well as to 4 Intermediate Intellectual Property Courts and 43 Intermediate People’s Courts via online participation. In his talk, entitled “Creativity, Market, Global Trade Order and Disorder”, Professor Guan revealed the interplay between creativity, market dynamics, and the institutionalization of global trade. In this evolution process, creativity-boosted technological advances both facilitated and formed an integral part of the Industrial Revolution’s proliferation in trade, with the WTO representing the contemporary institutionalization outcome.

As has long been established globally, intellectual property rights are private and negative rights. Intellectual property rights as creativity infused in inventive products and original works, along with the goodwill established thereafter in trade, are separate from goods and services in trade, and their protection function as a de facto competition regime in global trade. Amid rising trade fragmentation, coupled with the rise of creativity in the East—which has shifted the global creativity center to East Asia—the global trading framework is undergoing a post-Industrial Revolution reconstruction and rebalancing of the creativity-market-trade order “Three-in-One” institutionalization mechanism. This new institutional construction calls for an innovation-centered, competition-minded, and trade-facilitating post-Industrial Revolution intellectual property regime, rather than trade decoupling and “small yard, high fence” construction.

5月9日上午,關文偉教授受最高人民法院知識產權庭邀請,分享其關於知識財產權國際保護的新近研究成果。 作為法庭 “新知講堂” 2026年第二講主權人,關教授以“知識產權與國際貿易的秩序與失序”為題,與最高法院知識產權庭法官及其他在線參加的4個知識產權法院和43個中級人民法院的法官分享了關於創造力、市場、國際貿易秩序的相關關係的最新研究。

關教授的研究展示了歷史上歐洲的工業革命推動創造力經產品和作品進入市場,推動並得益於自由貿易全球化,最終以世界貿易組織(WTO)為當今世界貿易秩序組織化產物。 這一過程中科技、市場、貿易秩序互利共生,知識產權作為產品中創造力和作品中原創性的體現並經貿易產生商譽,其保護是該共生秩序核心的競爭法機制。 然而當今貿易碎片化打破這種源於工業革命的國際貿易組織化邏輯,進入後“工業[革命]化”時代。 隨著東亞創造力的崛起和創新市場中心東漸,新的創新、市場、能源共生機制正重塑一個鼓勵創新、促進貿易互惠、平衡發展與競爭的新的國際貿易新秩序。
