Asian Law Schools Association (ALSA) Empirical Legal Scholarship Workshop for Junior Scholars (22 June 2021)

In order to promote empirical legal studies, nurture junior scholars (including post-doctoral fellows and PhD students) who are interested in empirical methodology and provide a platform for them to learn about the new developments in empirical legal studies, the inaugural Asian Law Schools Association (ALSA) Empirical Legal Scholarship Workshop for Junior Scholars hosted by the School of Law of City University of Hong Kong (CityU School of Law) was held on 22 June 2021. The Workshop also hoped to increase the sense of community among legal scholars in empirical studies and to promote the application of social science research methods in legal research.

The organiser of the Workshop, Dr Lauren Yu-Hsin LIN (Associate Professor, CityU School of Law), welcomed all participants to the event. She introduced the two speakers who are experienced in empirical legal studies and also Prof SHEN Weixing (Vice-President, ALSA; Dean, School of Law, Tsinghua University), who delivered the opening remarks.

Prof SHEN Weixing first expressed his great thanks to the speakers who were presenting at the Workshop on behalf of ALSA and the President of ALSA, Prof TAN Cheng-Han. He believed that their contribution would make the Workshop meaningful not only to ALSA but also to all the participating young scholars. He also expressed his thanks to the colleagues from ALSA especially Dr Lin, who had put in a lot of efforts and time in organising the event under the on-going pandemic. ALSA aims to build a platform for legal talents and to provide more opportunities for junior scholars to communicate and to share new ideas with their peers. Given that empirical study is a trend in legal research and has drawn the attention of many legal scholars, Prof Shen hoped that the Workshop can increase the sense of community among legal scholars and promote the application of social science research methods in the legal field. At the end of his remarks, he mentioned that he looked forward to some creative ideas and discussion from brilliant young scholars, and thanked all participants again for their attendance which would make the Workshop a great success.

Presentation by Dr XU Wenming

Following the welcoming remarks, Dr XU Wenming (Associate Dean and Associate Professor, School of Law and Economics, China University of Political Science and Law) gave a talk on the topic of “Introduction to Empirical Methods in Legal Studies”. He started his session by expressing his thanks to ALSA for inviting him. The session covered the basics of empirical legal research, including framing research questions and hypothesis, data collection, ensuring integrity of data, data cleaning, two-sample t-test and regression analysis. Dr Xu introduced what scholars could do with empirical methods and gave a very good introduction to the concept of causal inference. The attendees found this lecture useful and that they benefited a lot from the lecture, especially from Dr Xu’s advice on how to get started with empirical studies. 

 

Presentation by Prof CHANG Yun-chien

In the afternoon session, Prof CHANG Yun-chien (Research Professor & Director of Center for Empirical Legal Studies, Institutum Iurisprudentiae, Academia Sinica) delivered a lecture on “Big Data, Machine Learning, and Empirical Legal Studies”. During the session, he discussed the new developments in empirical legal studies in relation to the use of big data and the application of artificial intelligence. Many attendees raised questions during the presentation and engaged in lively discussions with the speaker. With the detailed explanation given by Prof Chang, participants gained a deeper understanding on the potential use of big data and artificial intelligence in empirical studies.

Closing remarks by Prof WAN Wai Yee

The Workshop ended with the closing remarks of Prof WAN Wai Yee (Associate Dean, CityU School of Law). She thanked Prof Shen for giving the opening remarks, Dr Lin for organising the event, as well as the two speakers for delivering the excellent talks. She found the presentations interesting and she also learnt a lot from them personally. She mentioned that Dr Xu’s introduction to the concept of causal inference was very helpful in empirical legal studies. Prof Wan also expressed thanks to Prof Chang for giving us an overview on the new developments in empirical legal studies. She also mentioned that we could think about the potential implications of these new developments in legal scholarship. One of the goals of ALSA is to build a community of scholars through a series of workshops and events; as such, Prof Wan considered that the event was very successful and hoped that the participants could keep a lookout for future ALSA events.

為促進法實證研究,培養對法實證感興趣的青年學者(包括博士後研究生和博士 生),並為他們提供一個了解法實證研究最新發展的平台,香港城市大學法律學院 (以下簡稱「城大法律學院」)於 2021 年 6 月 22 日舉辦了首個亞洲法學院協會(以 下簡稱「ALSA」)法實證研究青年學者工作坊,並盼望能夠透過此活動增加法律學者 的實證研究意識,並推廣在法律研究中應用社會科學研究方法。

工作坊的主辦人林郁馨博士(城大法律學院副教授)歡迎所有參加者。她介紹兩位在 法實證研究方面擁有豐富經驗的講者,以及負責致開幕詞的申衛星教授(ALSA 副會 長及清華大學法學院院長)。

申衛星教授首先代表 ALSA 和 ALSA 會長陳清漢教授對出席是次工作坊的講者表示感 謝。他相信他們的演講對 ALSA 以及所有參加活動的青年學者別具意義。他還對 ALSA 的同事們,特別是林博士,表示感謝。在當前的大流行疫情下,他們為組織此 次活動付出大量的努力和時間。 ALSA 旨在為法律人才創建平台,為青年學者提供更 多與同行交流和分享嶄新想法的機會。鑑於實證研究是法學研究的一個趨勢,同時也 引起眾多法學學者的關注,申教授希望此次研討會能夠增強法學學者的群體意識,促 進社會科學研究方法在法律領域的應用。最後,他提及期待青年學者的創新想法和討 論,並再次感謝所有參與者的出席,這將使研討會取得圓滿成功。

徐文鳴博士進行演講

申教授致辭後,徐文鳴博士(中國政法大學法與經濟學研究院副院長及副教授)以 「法學研究的實證方法」為題進行演講。他首先感謝 ALSA 對他的邀請,演講涵蓋法 實證研究的基礎知識,包括構建研究問題和假設、收集數據、確保數據的完整性、清理數據、兩組獨立樣本變異數相同 t 檢定和迴歸分析。徐博士介紹法實證方法的用 途,並介紹因果推論的概念。參會者認為本次講座內容豐富,更令他們受益匪淺,特 別是徐博士對實證研究入門的建議。

張永健教授進行演講

在下午的部份,張永健教授(中央研究院法律學研究所法實證研究資料中心主任及研 究員)進行題為「大數據、人工智能和法實證研究」的講座。會議期間,他討論與使 用大數據和應用人工智能相關的法實證研究的新發展。許多與會者在演講中提出問 題,並與講者進行熱烈的討論。通過張教授的詳細講解,與會者對大數據和人工智能 在實證研究中的潛在用途有了更深入的了解。

温慧儀教授致閉幕詞

工作坊以温慧儀教授(城大法律學院副院長)的閉幕詞作結。她感謝申教授致開幕 詞,感謝林博士籌劃了此次活動,感謝兩位講者的精彩演講。她發現這些演講很有 趣,而且她個人也從中學到了很多。她指徐博士所介紹的因果推論概念對法實證研究 有很大的幫助。温教授亦感謝張教授為我們概述法實證研究的新發展。她還提到,我 們可以考慮這些法律學術新發展的潛在影響。 ALSA 的其中一個目標是通過一系列研 討會和活動來建立一個學者社群,因此,温教授認為是次活動非常成功,並希望與會 者能夠繼續關注 ALSA 未來的活動。
