CPLR PhD Seminar (1) Encountering the Exclusion of Constitutional Identity of Rohingyas: A Comparative Study

On 16 November 2022, from 5pm to 6pm, the first PhD seminar of the Public Law and Human Rights Forum at the City University of Hong Kong (CityU) was successfully held, with Md Rabiul Islam (PhD candidate of CityU) presenting his research paper. Dr. Fozia N Lone (Assistant Professor and Associate Dirctor of the CPLR, CityU School of Law) and Dr. Daniel Pascoe (Assistant Professor and Core Member of the CPLR, CityU School of Law), as well as several PhD and LLM students attended the seminar.

Md Rabiul Islam's report focuses on the constitutional identity of Burma's minority Rohingya people. He argues that the Rohingya have been partly excluded from peoplehood in the 1947 constitutions of Burma due to the critical examination and were entirely excluded in both the 1974 and the 2008 constitutions. Md Rabiul Islam seeks to discover and understand the rationale behind the construction of Burma's constitutional peoplehood and, based on comparative research, to design a new inclusive constitutional identity for Burma that includes the Rohingya.

After Md Rabiul Islam completed his 40-minute presentation, there were a 20-minute Q&A session. Finally, Dr Fozia N Lone delivered the closing remarks and thanked the participants.

2022年11月16日下午五時至六時,香港城市大學公法與人權論壇第一次博士生研討會在線下和線上順利召開,香港城市大學的法學博士生Md.RabiulIslam以《羅興亞人憲法身份的排除:一項比較研究》為題進行了報告。FoziaNLone博士(香港城市大學法學院副助理教授;公法與人權論壇副主任)和DanielPascoe博士(香港城市大學法學院助理教授;CPLR核心成員),以及數位博士生和法學碩士生出席了會議。

Md.RabiulIslam的論文關註緬甸的少數群體羅興亞人的憲法和法律身份。他認為,從去殖民化時代以來,受到緬甸主體民族主義的影響,羅興亞人在1947年被部分排除於憲法身份之外,並在1974年和2008年的緬甸憲法中完全被排除於人民身份之外。MdRabiulIslam試圖發現和理解緬甸憲法人民身份構建的理由,在比較研究的基礎上,為緬甸設計一個包括羅興亞人在內的包容性的新憲法身份。
