CityU Library's Digital Collections - Terms of Use
These terms of use ("terms") apply to all users ("you") of the CityU Library's Digital Special Collections ("Digital Special Collections"). Please read the terms carefully before you begin to use the Digital Special Collections. By using the Digital Special Collections, you indicate that you accept these terms of use and that you agree to abide by them.

The CityU Library ("we", "us" or "our") reserves the right to amend the terms at any time. Revised terms take effect immediately from the time they are published and continued use of the Digital Special Collections constitutes your acceptance of the updated or amended terms.

Any failure or delay in exercising or enforcing any right stated in the terms does not waive the CityU Library's right to enforce that right at a later stage.

Conditions of Use

By using the Digital Special Collections, you agree to follow these conditions of use:

1. Use of the works in the Digital Special Collections is solely for private study or non-commercial scholarly research purposes only.
2. Any other use, including mounting on other systems or redistribution in any formats is not permitted without prior consent from the CityU Library.
3. When using works from the Digital Special Collections, proper credit or acknowledgement should be given to the CityU Library by stating in your publications the following - “Digital Special Collections of the Run Run Shaw Library, City University of Hong Kong at http://www.cityu.edu.hk/lib/digitalcollections/index.htm have been consulted.”  
4. Responsibility for any use of works in the Digital Special Collections rests exclusively with you.

Copyright

The CityU Library owns and holds the physical copies of the works appear in the Digital Special Collections. We have made every reasonable effort to ensure that we have the appropriate right to digitize and provide online access to the works. However, the nature of archival and manuscript works sometimes makes it difficult to determine the copyright status of an item. In those cases where the rights are unclear, we archive but do not provide online access to the works in question. We wish to be informed by any copyright owners should there be any rights issues for works covered in the Digital Special Collections so that we may make necessary corrections.

Takedown policy

If you are a rights holder and have found that there are works in our Digital Special Collections for which you have not granted permission or are not covered by an exception or exemption in the Hong Kong Copyright Law, please contact us in writing at the address provided at the end of these terms with the following information:

- Your contact information
- The full bibliographic details of the work
- The URL of the page on our Digital Special Collections website where you found the work
- The proof that you are the rights holder or are an authorized representative thereof

We may cease providing online access to the work in question until we can determine that such use is permitted. Depending on the final resolution, online access to the work may or may not be released again.

Disclaimer

Access to the Digital Special Collections is granted by the CityU Library. We reserve the right to withdraw any items or amend any records in the Digital Special Collections without prior notice.

The CityU Library may prohibit access from some or all users to some parts or all of the Digital Special Collections due to technical, administrative or legal reasons. We will not be liable if, for any reasons, some or all of the Digital Special Collections are unavailable at any time or for any period.

The Digital Special Collections are provided on an "AS IS" and "AS AVAILABLE" basis. The CityU Library makes no warranty or representation regarding the accuracy, quality, currency, completeness, reliability, non-infringement, legal accessibility in your jurisdiction or usefulness of the content in the Digital Special Collections. The works may contain advice, opinions, statements or other information by various authors or organizations. The CityU Library disclaims all liability and responsibility arising from using such information by any user or by anyone who may be informed of such information.
