About the Moot

The International ADR Mooting Competition is an international mediation and arbitration competition that is open to all universities. It is conducted by City University of Hong Kong in association with the China International Economic and Trade Arbitration Commission (CIETAC), UNCITRAL - Regional Centre for Asia and the Pacific (RCAP) and Curtin Law School.

This Competition is also supported by a number of Universities and Organizations as Member Institutions.In the past years, several universities such as China University of Political Science and Law, Chung-Ang University, Columbia University, East China University of Political Science and Law, Edith Cowan University, Goa University, Gujarat National Law University, Harvard Law School, Hidayatullah National Law University, Hunan Normal University, Kathmandu School of Law, Korea University, Lloyd Law College, Macquarie University, Masaryk University, M.S. Ramaiah College of Law, Multimedia University, Murdoch University, National Chiao Tung University, National Law Institute University, Bhopal, National Law School of India University, National Law University, Delhi, National Law University, Jodhpur, National University of Singapore, New York University, Nirma University, Paneuropean University, School of Excellence in Law, Shanghai University of Finance and Economics, Shanghai University of Political Science and Law, Shantou University, Tsinghua University, Universiti Teknologi MARA (UiTM), University College Lahore, University College London, University of Vienna, University of Warsaw, Victoria University, Yonsei University, and Zhejiang University have participated in this competition.

The International ADR Moot is a competition for law students, either undergraduate or postgraduate. Because it is a competition that involves both mediation and arbitration it provides a unique opportunity for students to engage in the practice of these two important areas of dispute resolution as a separate means of dispute resolution or a combination thereof.

In each round teams will be engaged in both mediation and arbitration. In the moot, arbitration will be conducted first followed by mediation. At the conclusion of the arbitral hearing the two legal counsels for each side will divide their duties during the mediation with one acting as client and the other as attorney/legal counsel. In order to recognize the role and importance of a client in mediation, a new prize of the “Best Client” has been introduced in the 4th International ADR Mooting Competition. In addition, the “Best Mediator” has been renamed to “Professor Tang Houzhi Award for the Best Mediator” to show our appreciation of the work done by Professor Tang Houzhi in the field of ADR. At the end of arbitration the two sides will be given extra but separate facts which they can use in mediation. Those facts will be known to the judges but the third student who acts a mediator will not know those extra facts.

A third student from each university competing will act as an arbitrator and mediator for a different moot in which two other universities are competing. This student will serve initially as an arbitrator (one of three) sitting as the arbitral panel. Then the student will personally conduct the mediation that follows the arbitration. This competition is unique in how it combines mediation and arbitration. We aim to provide students with an opportunity to develop a high level of skills in both mediation and arbitration.

While competition will be intense we also strive to develop values of collegiality between teams who will come together in an atmosphere of friendship and respect. We hope that both professional contacts and relationships of friendship will be established during the competition.
